I was driving home today and a cop follows me so i ignore him and go about me business when I get to my house I park the car right in front of it. As I'm opening the car door and getting out I see the cop standing right there. So he gives a ticket for my tags being expired. But I was wondering can he do that after all I had the key out of the ignition and was getting out of the car when he pulled up. Oh by the way I'm in phoenix area. Thank you in advance

Yes, he can do that. You don't get to yell "olly olly oxen free" once you are on private property.
A cop can cite you for any violation that he witnesses--even if it occurs on private property. For example, if he drives by someone's house as they are beating their wife on the front lawn, he can make the arrest.

Man up and take responsibility for your actions.
Yes, the officer witnessed you driving the car with expired tags, and could have followed you right into the driveway (the street in front of our house is not your property, nor is it private) in order to cite you for breaking the law.

I believe in Phoenix, like most cities, it is illegal to park an expired tag vehicle on the street. He could have mailed you the ticket since it is not a moving violation.
Actually I think it was nice of him to allow you to get to your destination. Most cops would have you sitting in the car fuming on the side of the road.

What are you saying? The constable was an eyewitness to a serious infraction.
Can he write you up for it? Can the officer not be allowed to arrest a bank robber with a bag of cash in one hand and a gun in the other? After all, the suspect is not robbing a bank at that particular time.
Looking at it another way, should the cops not be allowed to arrest rapists, child molesters, terrorists, and axe-murderers other than when they are caught red-handed in the middle of the crime?

I would say...Yup. He saw you driving the car with expired tag. Since he witnessed you getting out of the car, (and probably got it on his dash cam), he had no doubt that you were the one operating the vehicle in violation of the law.

In front of your house isn't private property. If you run a red light and the camera takes your picture, you get the ticket at home, no?
