My daughter uses her father's last name. He presented a fake marriage certificate when I gave birth, which I was totally unaware of, and to my surprise, my baby had his last name. What can I do to have my baby's last name changed? I've googled it but all I can find was about a name change due to typo-errors.

I am in the Philippines and the law about illegitimate children using their father's last name was not enacted at that time...
By the way, I was still sedated when he filled out the birth certificate...yes he signed it!!!

I don't understand why he used a fake marriage certificate. You don't have to be married to put the father's last name on the certificate for the baby's last name.
If you want to change your daughter's name, go to your local courthouse and pick up a name change packet. Depending on where you are, some state's have a $200 filing fee, but you can do it w/o an attorney. Call the County Clerk's office in the courthouse if you have any questions. Sometimes you have to run an ad in a local paper for 4 weeks also (aimed at adults who have to show they're not trying to dodge bill collectors with a new name).

So you did not notice the change on the birth certificate when you SIGNED IT?
At this point the only option is a name change via the courts, It will be hard if the father disagrees unless you can prove your charge of a "fake marriage certificate"
Somehow I think there are major holes in your story.

What is so wrong with the child using her fathers surname? It is legally hers. If you want to have it changed to your surname, you have to go to court and have it legally changed. Even still, she is a product of two people. He will still be her father.

.. well you can go to the local city hall or call them and ask them about it. thats where you go to change or name where i live.. but i couldn't see anything about that situation on the internet either. .

go to the probate court and have them change the name easily. all you have to do is request it then it will be posted in the newspaper.
