I have a month-to-month lease that I want to leave at the end of this month. I'm supposed to give 30 days notice however. I don't really know that this apartment is fit for human habitation and besides all the other people in the house are constantly smoking pot and cigarettes (which i am allergic to). If I complain to the landlord do you think I can get out of my lease?? Any other ideas?

The landlord can NOT evict for drug use based on your word only. They need to be legally convicted for drug use. Right now it is your word against theirs.

I doubt you will manage to get out of the 30 days notice, but you can certainly ask.

I am unclear if you are renting a room or an apartment, but if it is an apartment you can not do much more then close the windows. If it is a house you should have asked if it was smoking or not before moving in. I know that does not help you now, but remember to ask next time.

Well I can only assume that you have been there for at least a couple of months. The landlord will ask why now are you saying this ? If you put down a deposit maby he will just keep that if you break lease.Normally on a month to month the landlord expects people to leave or the lease would have been longer. Just talk to him only thing he can say is no and then its still up to you ..

I agree with both Tim and igetayes. I would talk to the landlord first and then based on what he tells you make a decision on what is best for you! The landlord would have to do something obviously. Track every complaint you make to the landlord incase you do open a case and if he has a problem with your complaint and make a police report.

Complain to the landlord. If they do not evict for drug use, you have a case.

Is it a non smoking unit?

I would also call the police. They will get after the landlord to clean up the place if it continues.

Google landlord tenant legislation on your state and skim your hire. this would be construed as a safeguard drawback. However, to turn out that you just could want copies of arrest studies and centered on what you could have state right here, there have not been any arrests. Just your observations. Unfortunately your fears don't seem to be grounds for breaking the hire. Have you mentioned this together with your landlord? Report your observations to the police. realtor.sailor

Give your notice now, and plan to vacate at the end of December. Next door smokers are hardly a valid reason to terminate a lease.

If you are allergic to cigarette smoke, you should seek a non-smoking rental next time.
