I loaned someone money over a period of time to help them out. They said after they got their situation straight I would receive my money but it's been a year now. When I ask for my money all I get is excuses but how he's still stuggling doesn't have it right now. The problem is that now I am struggling and I really need my money back. I have decided to write a letter to the person and explaining if I don't receive my money by a certain period then I would take him to court. I also know he will respond by phone to my letter so I plan to record it and use it in court. However I'm am concerned that he might be like do what u gotta do. The problem is that I can't find the paper with the amounts (and time) that I loaned him though I do know the total sum. Also I don't have a promissory note like I know I should have gotten. Im just worried I won't get my money back if I go to court then I'm out more money I don't have for court fee's. Bottom line what are my options what steps should Itake

Small claims court is not that expensive.

IF you can get him to admit on the recorded message the amount you loaned him it would be a strong start.If you succeed in this the seek legal advice.Hope this helps and good luck.It sickens me when someone generosity is abused,I know from experience.
