I have Front and side airbags, my car rolled, and the airbags didnt deploy. I sustained injuries to my head. I was advised to sue the car company cause there was obviously a default with the car.. Would it be worth it?

the air bags do not automatically go off every time there is a wreck only when the car is hit the right way, like if a car smashed into the side of you then they would deploy so you didnt hit the door as hard and the same with a head on crash, it was probably safer for them not to deploy. And on a side note was it your fault that you rolled the car, then they arent to blame

You need to talk to a lawyer. However just because the airbags didn't deploy doesn't mean their was a defect with the car. It is possible that wiring to the air bags could have been damaged in the accident before the sensors signaled the air bags to deploy.

In addition you would have to prove that the head injuries you sustained would have been prevented from proper airbag inflation.

Your vehicle does not have a roll-over sensor and therefore will not deploy any bags under those circumstances. Only some SUV's have them due to the high roll-over potential. Your system is designed to deploy airbags if "impacted" properly . Check out this site and these blogs about just that topic.

This is America. You can sue anybody. You might not win, and I'm personally hoping you don't. But you definitely can, and to be honest, I would not bet against you.

Was the accident you fault? You can also sue the insurance company or the individual at fault. Sue 'em all and the deep pockets will pay.

You should ask a lawyer. I don't think you can sue the car company though. If that were the case, car companies could be held liable for every accident. I would still check with a lawyer.

Why is it that everyone in this country must sue the second "something" doesn't go right? What happened to mistakes or $hit just happening?? You were in a car wreck and got hurt - DUH! Is it Cadillac fault you wrecked your car too? Why can't you just be grateful your alive and well instead of greedy and try to make a quick buck off someone else?

if you have enough money to go after a car company like Cadillac than go for it. you have to remember they do have top of the line high shooting lawyers and alot of the time they go with out paying a cent. and your lawyer gets paid either way am i correct?

you can file a suit against them ,winning it is another story ,but i think in your case you would have a good chance of winning this one,you,ll have to get a statement from a mechanic finding the exact fault as to why they didn't deploy,and go from there with it,you cold win this one with a real good lawyer though,but remember who your up against,gm,they have many good lawyers for this kind of matter,good luck on it.

Only if you can provide proof that it is a defect in the manufacturing process and not a fault that occured due to mechanical breakdown
