I filed for divorce last week. Last night I was out with a friend and my husband totaled our one and only car in a car accident. The car was in his name and his dad cosigned. I am only on the insurance though my husband doesn't worked I have made all the payments on the car. Anyways now I have no car. My question is can I get a new car in my name now that the papers have been filed for divorce or should i just bum rides from people till the divorce is final? I can afford a new car I mean I paid everything for the car it just wasn't in my name.

You can get a car, just don't put his name on anything.

Just wait because you are still legally married an when you are married you half everything!! So you getting a new car is only giving him reason to fight you if he's that type an most men are!! So hold out until you are done with this guy an then like a divorce present get you a new car!!!! Make sure the car is only in your name so he can't ever take your car!!!No matter if the car was in your name too he'd probably fight yo for it unless you have kids then he has to provide you a care for your kids! But be smarter next time don't pay anyone's car payment but YOURS!!!!!!!

People that know me know me as being silly. Picturing myself receiving e-mails of the owner or President of the company posing nude would make me laugh uncontrollably. Would I be offended or weirded out? No, not at all. I'd know it was some bitter critter seeking revenge. Of course, I'd never share the pics with co-workers but I would tell the owner and President what was sent, by forwarding the emails. OMG!!! Just thinking about it....I'm laughing! Lol! If someone sent them e-mails of me nude, the President would most likely say ummm...this is interesting, who sent this, and why am I receiving this. Is this my Leasing Consultant? Well, what in the world? The owner would most likely have the IT guy try and track where the e-mails came from. He would most likely have a look of complete shock on his face and then get a little upset. Would they tell me? No, not likely. He has so many agents under him, I don't if he would care to look up to see who I even was. With or without the e-mails, our work day would continue as any other work day. I have no shame. I could care less if someone did this to me. I'm sexy and I know it :)

Two issues:

Who owns the car at the end of the divorce? If you purchase something prior to the actual divorce, in most states in the US, it becomes community property, regardless of whose name is on the title, whose paying the loan company (if one is insolved), etc.

There is no such thing as "my" money until AFTER the divorce - consequently, half of it, as an asset, will be his. You'll get half a car's value less in the rest of the settlement, if that makes sense.

You can specify on the insurance that he is NOT allowed to drive it, and therefore not have to pay higher insurance premiums.

Look you need to consult a professional divorce attorney. Issues like this sometimes can come back to bite you. Consult the attorney who helped you file and he will tell you what you can or cannot do by law. Remember you have to go by the law, if not you may be getting a car that he may get half the market value.

The car was a joint asset when it got wrecked. Therefore when the insurance company replaces it, the new car must also show thart same joint ownership. He can sign it over to you but that's wasted time because the divorce is in motion now and the car will go to whoever the setlement dictates.

Yes you can get a car in your name. Both of our vehicles are in just my husband's name. Getting a divorce has nothing to do with buying a car.

If you have filed and have a legal separation as ordered by the court the you can likely go purchase a car in your name without it becoming community property. However, I would consult with my attorney about it prior to making a decision.

I wouldn't buy a car just yet... unless it was a hooptie I paid for with cash. But since you're filing for a divorce, I assume you have a lawyer. He/she would be the best one to ask for advice.

You can get a car in your name whether you are divorced, married, single..it's just your car...you don't need anyone's name on it.
