If more than half of the states in the USA pass medicinal marijuana laws, can marijuana be legalized by having a state majority rule? (I forget the name of the legal term for it.--state's 'referendum'?).

As long as the federal government keeps Marijuana as a schedule 1 drug it will not be considered to have any medical use, at least by the federal government. States can pass laws trying to legalize it but the feds will come in and try to stop it. The feds seem to always get their way, all they'll do is threaten to cut funding to the states and the states will cave in.

No. Each State makes and enforces their own individual drug laws. The federal government has their own drug laws. If you are arrested by a State or local law enforcement officer/detective you will be prosecuted under their laws. If you are arrested by a fed, say DEA, you will be prosecuted under federal law. If the feds ever pass a law that marijuana can be used for medical purposes, which won't happen unless Hillary wins, you will have a good defense under any State prosecution. Hey, Michael S. I'm a die hard Republican. One thing most of Republicans believe in is that the Fed govt should be smaller and leave it up to the State and local govts to manage their people and turf. If the State wants to legalize marijuana for medical reasons and it is a fair and just law most of us would not have a problem. If the State law is passed to just let idiots get stoned than the Feds should rightfully step in.

The states can legalize it, but the Feds haven't. So even if you're using it legally in your state, the Feds will bust you. It's a real shame, but it happens all the time. Federal laws trump state laws.
