A person's Constitutional rights exist because the person is inside the USA, not because they are here illegally. INS will do what needs to be done to remove the person (though maybe making this happen is close to impossible), but that person's rights as a human being are linked to his humanity, not his legal status.

Yes and no. If it was an accident and you stopped and called the police, you would probably be exonerated. However, if you hit and ran, then it's a crime.
