If you have a relationship with a married man you are hhis mistress How and what in his marriage agreement does not change that The only thing that could change it if it is with the wife's blessing then you'd be the girlfriend (as mistress is kept in the dark and hidden for society reasons)
And yes it is adultery if you are a mistress.

The new couple, man and mistress, can only marry if the man is divorced (at least in western countries)
But why would you want to marry discarded goods? Also if he has a mistress pon the side with one marriage, why not with the second?

adultery is when u are intimate with someone who is married to someone else. they can marry but all u will be getting is a cheater, if he will do it to her he will do it to u too. don't be so arrogant to think that somehow he loves u more than he loved her. he will find fault and cheat on u too after the honeymoon phase is over with.

A mistress is anyone that sleeps with a married man. It doesn't matter what kind of agreement he had or has with anyone. A spade is a spade.

Well, if he was married and you had intercourse, that's my definition of adultery. Pre-nup nothing to do with it.

Good luck
