Only answer this if you know anything about civil law.
In short, I was in a car accident caused by some foreign idiot who I took to court for damages. The judge ruled that the moron would not be liable for my damages (even though I had a notarized witness statement), but he also gave this individual an opportunity to counter sue; which this person declined. The judge told the person that that would be the only time he could file a claim (sue me for the incident). My insurance company went over the evidence and refused to pay that individual's insurance company. Now the insurance company is trying to come after me. First, a year after the accident. I sent a copy of the ruling to the law firm and they immediately dismissed the claim against me. Now, three years later they are at it again only with another law firm. I am going to get a lawyer this time and deal with this within the next 30 days, but isn't this harassment? A frivolous lawsuit? Can I sue the insurance company?

I didn't have full coverage so my insurance company told me to sue the individual to collect for damages. In court, the judge seemed overly annoyed and ruled that the individual did not have to pay for my damages, and because that individual declined the counter suit neither did I. Basically, we were both responsible for our own losses since it was my word (and witness statement) against his word (and his idiot son for an interpreter) What kind of lawyer deals with issues like this? What is this called?

The insurance company is seeking $3,500 and the initial case was handled in small claims court (no lawyers allowed)

It's NOT your problem to deal with all this stuff. Your insurance company has an obligation to defend you. All you have to do is pass anything you get on to hem, and they'll take it from there.

Yep! Get a lawyer. Why didn't your insurance company provide a lawyer at the initial trial?

File a counter suit against them for 1/2 Mil and be sure you have good documentation of all evens. The mental anguish you have suffered surly is worth that much.
