Usually none.

Mistakes happen.

The recourse, if the hospital or doctor won't agree to a settlement that both sides are happy with, is a medical malpractice lawsuit for simple negligence. Bringing "patients rights" into it usually means you're trying to make it some sort of breach of contract case based on some statement of a "patients bill of rights" being part of an implied contract.

That's usually unnecessarily complicating a simple negligence case. Beware of lawyers that want to complicate something that should be uncomplicated.

Depending on the State and Federal Guidelines of course, but there are a lot of similarities. According to federal law, each trained medical professional is responsible to act under their best judgment, and perform all protocols to each protocol equally. For "wrong side surgery", you may be able to get a lawsuit for negligence, if you can prove that it was the doctors fault, and he damaged you in any way. Speak to a lawyer and see what they say.
