i am an 18 year old who works full time in Texas. i work from 12 to 7 monday through friday and 10 hours on saturday. After being asked to sign my timesheet i saw they took have an hour out of each day, even though i was never givin a break and worked that time. they tell me theres nothing i can do about it and that its a law they cant get around. ive found no where where it says breaks are mandatory in texas or that they can not pay you for time worked. do you know any legislation that would help me or any proof that this is in fact illegal? thanks

Breaks are not mandatory in Texas, so they don't have to give you one.

But... if they DON'T give you one, they can't then stop an hours pay as if they did.

You must be paid for ALL the hours you actually work. Texas DoL does not enforce wage disputes though, so your only recourse is to sue your employer in small claims court.

Plus, of course, just take the break that they're stopping your pay for anyway.

Contact the Texas Workforce Solutions office near you. They also have a website (sorry don't know the correct web address). Hopefully, they should be able to point you in the right direction for answers.

You should not have signed your time. You need to report this to the Texas Workforce Commission. They owe you $, but if you signed that you agreed with your time, you will have a hard time proving it.

And you are correct, you are not forced to take a break.
