A FRIEND of mine eas married but got divorded her husband went to live in dubai they had a joint account, and she thought it was dealt with and now 5 yrs later theyre chasing her for the £7000 debt, they said cos hes out the country she has to pay.

is this right?

If she filed for divorce and has the records to prove it and prove she notified the bank to remove her name she should not be responsible, but if she never notified the bank, then unfortunately yes she is responsible.

The procedure sounds like what is called an "offset". An offset is the legal term when money is taken or offset to satisfy a debt. Yes if it was a joint account any creditor can attach the money in the account. What you want to do is look at the savings account agreement when you opened the account. Many financial institutions have offset provisions. This is fairly common if you have a loan with the bank, they will get you to offset any monies in savings, cd's or checking accounts. Sorry but it appears to be legal. Good Luck

His being out of the country does not matter. They are 'jointly and severally liable' for the joint account. Legally, they both owe the FULL amount. The bank can go after either or both of them. She is easier to find, so they chose to go after her. If he lived in the same house as she did, they could STILL go after her and ignore him.

legally yes, as it's a joint account. I would seriously get my *** to the Citizens Advice.

if she has not comunicated with these people advice her not to for another year.a debt seases to exist if 6 years have passed since it was last asked for.if she has comunicated then you need legal advice,they need to see the financial official setlement she made with her partner at the time of divorce
