The first business day following January 1st for a paper return. For e-filed returns the IRS announces a date each year, usually around the 15th of January or so.

As a practical matter you can't file until you receive your Forms W-2 and any other tax records necessary to prepare your return. Most of those are not due out until the end of January so most folks can't file until early February.

You may file them as soon as you think you have all the data.

Most folks don't have all the data until the last paycheck.

Of course all this will be moot when the FairTax Act H.R. 25 passes and replaces all income taxes with a single sales tax on new items. The FairTax now has the support of hundreds of thousands, 72 congressional sponsors / co-sponsors, and 7 presidential candidates. See www.fairtax.org

If you file anything more complicated than a 1040EZ or a 1040A without dependents, expect a huge delay this year. Congress hasn't patched AMT yet and the IRS reported they needed at least 10 weeks to code and test any changes.
