I am not sure what you are asking but if it is an implied contract about not suing if you get sick or hurt then yes.

An implied contract is any commercial transaction not governed by an express contract.

If I walk up to your hot dog stand that has a sign up saying "$1 each" and hold out a dollar, you take it, we have an implied contract. By holding out the dollar, I made you an offer. By taking it, you accepted the offer, and you and I had an implied contract for you to give me a hot dog. If you just pocket the buck and don't give me the wiener, I can sue you for breach of contract.

The same deal probably applies in the cafeteria. If the sign says "Apples 50c" that's an offer. If you hand the cashier 50c for it, you've accepted the offer and created a contract. If she won't give you the apple, she's in breach.
