I rented a room at one lady's for a year and a half. After a year my bed broke. Not because i was jumping on it, it just broke, guess it was a bit old (before that an thin old table,too). So my landlady was smart enough to offer me to get the bed for which i had to pay! She didnt have to,as i got a bed for free from my friend (of better quality she wanted to get me). Well,now,that is 6months late

So, now 6 months later,i decided to move out. My lanlady doesnt let me to take my bed, i even offered to pay for it, but she says she has no time to deliver the new one. How convenient,hug? Pls,advice me,shud i pay for the bed (not more she was going to buy for) and just take it or leave it and not to get anything? By the way, i think i shud take it and dont pay as its not my fault the bed broke

You should have been clear with her and who owns the bed. Had the old being broken under normal use, the landlord had to replace it if it's part of the rental agreement to provide the bed as part of the apartment furniture. If you got the bed from your friend, then you take the ownership of the bed.

If the landlady wants it, she has to pay for it. If the landlady decides to deduct your room deposit because of this, you are within your rights to sue and reclaim the money. I suggest you read your rental agreement, and make sure what legal rounds you have. Good Luck.

This is a bit difficult...

If she allowed you the opportunity to bring your own bed in (rather than say that she want's her's repaired).... then you did just that, no? YOu brought YOUR own bed in.

What did she do with her broken bed? Unless you broke it through abusive practices, then you potentially might owe her something, but not a bigger and "nicer" bed.

THe bed from your friend was a gift to you, not to your landlady, correct? You should kindly explain this to your landlady. IF you have to, ask her why she thinks that her friend would have given her (the landlady) such a generous offer as that?

Maybe she feels that it's entirely your responsibility to replace the old and broken bed. IF THIS IS HOW SHE FEELS, then only you know if she has a point, but if she rented you a room with a bed, and the bed broke without you abusing the furnishings, then she is the one who is responsible for replacing it.

The key issue for you to figure out is, "who is responsible for the bed's demise?" if you just used it as normal people do---again--- then you are not responsible at all.

There is a law in Massachusetts regarding rental units, and it allows for "reasonable wear and tear" which is the exact wording of the law, which seems like a reasonable law for the rental of a furnished apartment.

Otherwise, you can tell her that the room you rented for the last six months was a room WITHOUT a bed, and she owes you money in return, as this was not the original deal.

If it is a furnished apartment then it is her responsibility to keep it furnished with usable furniture. If you got another bed from your friend then it's your bed pure and simple. Whatever problem she has getting the bed she ordered is her problem not yours. Contact your local housing authority. If she doesn't give your deposit back take her to small claims court immediately after you move out.

i would say that the room was rented with a bed in it when you leave there must be a bed left in it. unless the bed was defective, you where in possession of the bed and should be responsible for replacing bed

Well-no that is te beauty of renting-when it broke originally she should have had it fixed or replaced not you. Take you bed with you.

If you bought it and can prove it, the bed is yours to take/keep or sell.
