My son is in rehab and my ex-daughter in law says that she doesn't have to let me see my granddaughter, who is 5, on what is my son's weekends. We took her to see him in another town yesterday and her mom is throwing a fit. My son has a history of drugs so I don't want to push the issue. Can she get where she doesn't have to let us have our granddaughter? we always have had our granddaughter since she was born by the way on the weekend that was our sons.

The best thing you can do is get a lawyer. It depends on what state you're in and what type of custody your son and daughter -n- law have written.
There are many lawyers out there that give free consultations, therefore, it would be well worth it. You might just be surprised of what you can do in your situation.

Unfortunately since you aren't considered legal guardians, you do not have any specific legal rights to see your granddaughter.

That being said, there's nothing stopping you from filing for a motion in court to establish some sort of court ordered visitation. Courts will sometimes order visitation to grandparents if they feel that it's in the best interest of the child.

Best plan of action would be to speak to an attorney asap to get things going.

Your problem will probably end up in court. Grandparents are getting more legal rights for visitation with Grandchildren though.
