I have a 1998 bmw 328is m-tech i am having problems selecting all the gears, I took it to a local garage which advised me that the clutch was worn however, when the car is in gear it runs smoothly and no unfamiliar noise is heard also the car does picks up speed without the clutch slipping.. Advise please!!!!!!!

Could well be the clutch release rather than the actual friction lining that's worn, either way, it's a new clutch.
There is a possibility it's the gear linkage that's the problem, but it's not a common BMW fault.

If the clutch has grip, doesn't make noise, but won't let you select gears very easily, then it's most likely that the clutch friction surface has worn so thin that depressing the pedal doesn't completely disengage the clutch. When it's still spinning the input shaft on the transmission, the selector can't get into gears. This job is quite spendy on a BMW. Your car has a dual mass flywheel which complicates things somewhat. If you have to have the clutch worked on, and the mechanic wants to fix everything while they are in there, they aren't ripping you off. The labor to remove the transmission to get to these parts is so extensive that you don't want to have to go back in for another part later on.

If the pedal has become soft, or ever falls to the floor, you have a different problem altogether. If this is the case then the hydraulics are on their way out. This is far less expensive than replacing the mechanical clutch components, and something that a mechanically apt person could do in their driveway.

If any of your shift linkage components have failed, you'll know it because the shifter will move around very freely or will have a great deal of slop.

From your description, I'm pretty sure it's the clutch release fingers/bearing.... you're looking at a $500 clutch replacement.
