Do you know if you are an exempt or non-exempt employee? Exempt employees are usually professionals or managers and are salaried and get paid a certain amount no matter how much they work. Non-exempt employees are usually hourly and get overtime.

If you are non-exempt, and you are working on your lunch hour and not getting comp time for it (i.e. getting to leave early), your employer is liable to pay you overtime for the time spent working during lunch (depending on how your work week and overtime works -- 8 hrs daily or 40 hrs weekly).

This is why your boss should make sure you are NOT working during your lunch hour if you are not getting paid for lunch. Same with working before you officially clock in.

I'm the manager here, so I stay late if I need to stay late and go home early if I can.

Unfortunately not. If i work my lunch hour then I've lost the time. If i work on late or do too many hours then I've lost the time. It's nice to have a caring employer, I just wish I had one!

Yes we can take our lunch at the end of the day and leave an hour early but we can't make it a habit.

At this job yeah, they are super cool.
At my last job I would actually be expected to work thru my lunch hour sometimes. I cannot tell you the number of times we went without food. It'd be like a coke and if you had crackers in your drawer you were lucky!

Yes they can. There is no law stating that you have to work an 8 hour shift.

I actually come in later, work through lunch, then go home at my regular time.

Not allowed to do so. It's a law everyone must have a lunch break so they make you take it if you want to or not.
