Someone at work mentioned to me today that she thought that because my boyfriend and I are not married that I won't be able to put him on the birth certificate when our baby is born? Does this differ by state? If so we live in Florida so any information would be helpful.

You can put santa clauses name on that certificate, as long as the paper is filled out. I am an unmarried mother, her dads name is on hers, (pennsylvanian)

Im not sure about Florida. I know that in DC, i am delivering at GW University Hospital and they said my bf would have to fill out some papers before the baby is discharged in order for his name to be on the birth certificate, but if he doesnt fill them out before the baby is discharged then there won't be a name for the father on the certificate until he goes down to whatever office building... i guess vital statistics and fill out some paperwork and pay a $40 fee to have his name listed as the father.

Im sure this doesnt help with your being in Florida and all but I thought that maybe it was a start and could give you some insight. Perhaps it would be a good idea to do as I did and call down to the hospital you will be delivering and ask them a few questions about it. they should be able to tell you.

My husband had a child with a girl in high school. They were not married and never got married, but his name is on the birth certificate. Florida Laws might be totally different, but I am willing to bet that he can go on there. When they give you all the paperwork at the hospital, ask then. If you want the baby to have his last name, his name has to be on there. Good Luck.

Check with the state capital, department of Vital Records, but most states allow the fathers name whether you're married or not.(hospital might know)
Did you know that at one time, there was a separate birth certificate for children born out of wedlock? It stated 'illegitimate' on the BC; I believe it was as early as the 40's.
Mine was issued in 1949 and it has Legal at the top and in 67', the only way to list the father was if he paid for the birth.

I had the same situation, I live in Florida as well and it does not matter if you are married at all. He is the babies father it is his right to have his name on the birth certificate.

Yes - the father's name can be on the birth certificate even if you're not married... However, he has to sign an affidavit of paternity claiming that the child is his. His name would then go on the birth certificate. You can't just put his name on there without him being present.

Living in Florida, and just having had a baby 4 weeks ago, I can answer this for you. If you are NOT married, he will need to be present to sign his name on the birth certificate. There is a separate section for him to sign with his information and he will have to be present with a witness for him to sign. My husband and I were talking about how strange it was that he did not have to sign at all since we were married.

They want him to have to pay hundreds of dollars to file to adopt his own baby? That's the dumbest thing I've ever heard of. It sounds like they're trying to come up with a way to push him out of your life or ensure that he can't get custody. Whether he is on the birth certificate or not, he is still the baby's father and can file for custody or visitation if things don't work out between the two of you. And if he went to court to 'adopt' his own kid, they'd probably laugh at him... The only reason there should be no father listed is if you don't know who it is. Or I guess you wouldn't want to list it if the father was some kind of serial killer or something... :-/ Put it on there. Even if you guys don't get married like you plan, he is still and forever will be the father.

In Wisconsin you don't have to be married to put the fathers name on the birth certificate

In Florida whether he is or isn't the father he can put his name on the birth certificate. If he is found later to not be the dad, well he's screwed. He'll have to pay support because he assumed paternity.

yes his name can be on here, although different states have different stipulations to this.

in Virginia where i live i was just reading at the hospital that if the parents are not married the dad has to be there to fill out paperwork in order to be on the birth certificate, so i would call the person in charge of the certificates at the hospital and ask them what the policy is.
