I got a DUI around a week ago. I have an Appt with the best lawyer in the town I got it in. Im getting a little anxious about the possible outcomes. I am guilty of it and the evidence is strong but it isnt foolproof. There was a wreck w/o any injuries. I havent yet spoke with my lawyer b/c he apparently is very good and booked for a few weeks.

I have 7 years Military(4 active marines) ,3 w/ National Guard, and my unit was just alerted for a Deployment in the 12 months.

My question is for current or former Lawyers or Police officers. Are there any type of plea bargains that I may possibly get? I am just trying to get a handle on the possible convictions and punishments.

Just to clear things up for those who were generous enough to answer... It is my first, and last DUI. I blew a .11. I was completely cooperative with the officer and did well on the field sobriety tests. My record includes some speeding tickets and a retarded 2nd degree tresspassing (pjc) that i got 10 years ago. The DUI was in NC.

My wife (from whom I've been separated for 5 years because of her alcoholism) just got her second DUI in less than three years. She was under house arrest for thirty days, lost her license for a year, and will be on probation for 3-1/2 years. Without a plea bargain, she could have faced a year in jail and a $15,000 fine.
Each circumstance is different, and each state has different laws. While I personally believe drunk driving is a serious infraction, I - frankly - would rather be on the road with a drunk driver than I would with some 'nut cake' using a cell phone while driving. Hire the best lawyer you can afford; the unfortunate thing about DUIs is that it's not as much about keeping the roads "safe" as it is about money.
I can tell you from first-hand experience that the legal system, the courts, the corrections programs, and the alcohol-deterrent programs (at least in Indiana) are inefficient, sloppy, unorganized and completely divorced from each other. The right foot doesn't know what the left foot's doing....and nobody (lawyers, police officers, judges, counselors, case workers) gives a damn about trying to help chronic alcoholics recover from their disease; the only thing they care about it money and control over these 'offenders'. It's a stacked deck, rigged in favor of those who profit or benefit from another's mistakes.
Again, let me be clear: I don't condone drunk driving, and I believe drunk drivers deserve to be punished. I think that drunk drives have become an 'easy target' for charlatans who work under the guise of trying to "help" when, in fact, all they're doing is trying to eek out a comfortable living without doing a helluva lot of work. -RKO- 11/19/07

Listen son, the best thing you've said so far is that the DUI is your "first and your last." However, even though you sound truthful about it never happening again, the best solution to make sure is for you to take some kind of responsibility for your actions that fateful day/night whenever. It's possible that your lawyer can make some kind of deal to help get your sentence reduced, but you should for your own good go ahead and take the punishment whatever it is and hopefully learn from it so you won't ever find yourself in a similar or worse situation or put some innocent person in a bad situation. On a first offence if you plead no contest you would likely get a fine and maybe sustance abuse counselling. You may lose your licence for a short periof. As you say, you are guilty, your best bet then would be to accept the guilt and get a deal.

FYI...a very good lawyer will likely tell you to take it to court.

FYI...a police officer will not be able to tell you much about the plea and court process, after the time of arrest and evidence collecting they pretty much are out of the loop until they are called to testify.

in most cases were there was not any injurys the county DA, will allow you to plead no contest to your frist DWI, and ask for a fine and possibaly some kind of serves to the town or county were it happened. It should not affect you on your deployment. Good luck and gods speed.
