I am moving from Louisiana to Texas. I have purchased a home and the closing date is December 10th.

The problem is, I have an 8 yr old daughter that (my court papers say) I share joint custody .....but, we have not heard from her father in over a year. He has not had any visitation nor has he tried to contact her since christmas last year. He has made 3 child support payments in 3 years with the last being Oct of 2006. He does not have a job nor a house. The last place I knew of him living was with his fathers girlfriend.

I looked up online (and called an attorney to make sure that I have to do this just to cover my butt) and found out that my responsibility is that I must notify the father by sending him a" notice to relocate letter" to his last known address by certified mail. I sent the letter to the girlfriends house this morning but I still am unsure of his whereabouts. Soooooooooo what if we hear nothing back - does that free me to move?????

Contact your lawyer or the judge who worked on your case just to be sure. If you can't find him I would assume there is not too much you can do about it. You can't stop your life just because someone doesn't want to be found. But, like I said, contact someone in the law system to be sure and to save your butt just in case he turns up after you move and fights it.

It is true about sending him a letter at least 30 days in advance that your moving. Call a lawyer and get more info. If you haven't heard from in three years it doesn't matter. You have to do everything legally. Good luck!

It all depends upon what it says in your divorce/custody/support papers. WHY didn't you check on all of this BEFORE you started househunting?
