Their tree limbs are even hanging on our roof and they won't get them cut . Gr-rrrrrrrrrrr Now their roots are causing cracks on my walls....I myself have no trees....thats how I know it is theirs causing probably a 10 grand foundation repair that I cannot afford. What can I do ?

In my State,you would be responsible for any extension of branches, roots, etc that hang over your property. You have the right to cut back the branches to your property line and you have the right to do whatever you need to with the root that is in your yard to correct your foundation. Their insurance is not liable. Hope you can get your foundation repaired and do whatever you need to that will prevent the new foundation from cracking or warping. Ask your insurance company if they can help you. If you don't have insurance, it's probably something you'd want to consider getting.

What is the history with the neighbor? Have you asked them in the past to restrict the tree's growth? If you have (ever) assured them that you like the tree 'as is grows', that may be considered permission to let it grow larger than the space really allows.

In my area, if a neighbors tree crosses the property line, you may harvest fruit, trim branches, etc -- although you are not required to. Trees over property lines have been the cause of many, many neighbor disputes. The health and look of the tree are always in contrast to the roots, limbs, leaves and fruit dropped into neighboring yards.

It is a good bet that a claim to your own homeowners insurance would be chased by them to the neighbors -- letting the insurance company be the bad guy. I'm not sure that their homeowners insurance would specifically cover your damage -- unless limbs fell onto your home or vehicle.

Get your OWN insurance policy out, and look over it for definitions -- most policies are similar, so the way your company might cover damage YOUR trees could do to another's property is a good starting place.

Contact an attorney and ask them> If nothing can be done than cut the roots and trim the tree>

They must pay for this, not you. Ask your homeowners insurance what to do ot get an attotrney.

Their homeowner;s insurance should cover it. However, regardless of who pays, them or insurance, it should NOT be you!

They are ultimately responsible.
