My new partner's ex is a police man who works in survailence with access to IT equipment etc. I opened her a sub account attached to my bt account. she gave him the address over the phone and he sent her one e-mail. then phoned to say that he would not send any more info over that address because i am the account administrator and will have access. Has he acted illegally in tracing the e-mail address back to my account? I thought this was not possible? We think he has acted in appropriately by using police facilities to trace this back!

You don't need any equipment, just need to be able to look at an email header.

Stop being paranoid.

From what it sounds like is that your partner's ex is paranoid YOU will read the messages.

As for 'tracing the account' it's not illegal it's more like looking at caller ID.

The one way that he could do this easily is if he sent the message with a return receipt which many don't know sends an email back which is traceable.

But also if you are listed as the admin in Whois you then potentially have an issue.

Overall technically and legally with the email and tracing I don't see any issue. HOWEVER if this is BIG issue for those involved there is more of a problem in the relationships than email tracing.

It's quite possible that the information in the headers was enough to let someone know the account is owned by someone else. Or it is possible that she told him you were the administrator of the email account.

There could be a bunch of reasons that someone could have that information without the answer being a police officer abusing their powers. Also, for him to obtained it via abuse he would have gone to your ISP and obtained the information from your ISP without a subpoena which would be a violation of the ECPA. So I highly doubt your ISP would be that stupid even if he was. There's no "IT Equipment" that would just tell someone that... at least none that is illegal to use.

If you truly think someone has abused their power you are more than welcome to contact the authorities and file a complaint...
