I am a stay at home mother, my husband works. I do recieve disability but it is not taxed and I don't believe I claim it. Does anyone know how my husband should file? Would he file as head of household, Married filing jointly or married filing separately?

We are looking at the highest return option basically. We won't have to pay anything out. He hasn't claimed any dependants all year.

married filing jointly will result in the lowest amount of taxes you have to pay. Your lack of income will help to offset most if not all of his income.

Married folks who live together have but two choices, Married Filing Jointly and Married Filing Separately. If would be hard for me to think of a circumstance in which you would want to file MFS. So that leaves MFJ as the most favorable.

You are married, so have to file that way no matter who does or does not have taxable income.

He is NOT allowed to file as head of household. Choices are to file a joint return with you, or file as married filing separately - filing a joint return will be better financially, and will also be better than filing as head of household even if he could do that which he can't.

And by the way, depending on the type of disability you get you might have to report it, and might have to pay tax on it. If it's social security disability, you will have to report it - whether you pay tax on any of it depends on your total joint income.

Your choices when you are married are "Married- Filing Jointly" or "Married-Filing Separately".

In your situation, I would not even think about a status other than Married-Filing Jointly.
