As far as protocol for patriarcial names goes, can it skip a generation and then continue?

Traditionally you don't skip a generation, but you can still continue it. There's no law against it!

My baby is taking my husband's first name, but not middle. We will still think of him as a junior when he really isn't since the middle name is different.

Absolutely it can. The II and all is just about being the next one in line.

I would not do this only bc people are going to think his father was the II.

yes if the father is not the III then he will be if named after the grandfather

yes. like royalty, Elizabeth I is quite a distant relative to Elizabeth II. so why not?
