On 25 Oct 2007 11:30am, my car was hit by a truck. I have made a claim on the second day. And received a letter on 19 Nov 2007. The insurance company said their clients versions so are different at that point. They must support their client. If I have an independent witness who is prepared to support my version of the acciden. Then they will change their position.

The truck driver version

I was hit by a truck driver. He said I'm tried to turn right
and then turn left again. It's not his fault.

My versionI

I found that a big noise crash from my left hand side. And
saw a big truck hit my left hand side. I slowed down my car
and press the horn. The driver was driving away. I stop my
car and checked the passenger side mirror was broken. I
kept press the horn. After two left corner, the driver was
stopped by two people on the pavement. So I got the
information to make a claim.

What can I do?

did you call the police?
if you have a police report that shows what you said you are covered but it sounds like you did not call the police. no police report your word against his they are going to fight you. get your witnesses and re present your claim or you can have your insurance fight the battle for you. they will be happy to try and keep from paying. if you can not get resolution and you have witnesses that will testify then as last resort contact a lawyer.

#1. Hope you got the name of the two people on the pavement that stopped him from driving away. If you did, send the insurance company their names. They can at least validate the fact the truck driver tried to drive away.

#2. Hope you called the police at the time of the accident and filed a police report. If they came and issued any citations that will go a long way to support your story. If you did call the cops you could have checked to see if there were any traffic cameras at that corner that might have caught it all on tape.

#3. Hope you informed your insurance company of the accident at the same time you filed a claim with the other insurance company. There is a requirement on most policies that they have to be informed of any claims "in a timely manner."

If you did NOT do the three items listed above, you are screwed. Without any witnesses it is just "you said, he said."
Without any police report, you gave him plenty of time to concoct a story for his insurance company. By not informing your company in a timely fashion, you relieve them of the requirement to pay as with the passage of time, you decrease their chances of being able to recover.

If you did not do the three items listed above, just go to a junk yard and buy a matching mirror for your car. You can probably do that for less than your deductible on your car. At least then your insurance company will not raise your rates.

And by the way, you say "say a big truck hit my left hand side." But then you say "checked the passenger mirror was broken." If you are not in a nation that drives on the left hand side of the road, your story is not consistent. You need to realize the Internet is international and little details like that stand out.

If the insurer refuses to pay, you sue the truck driver AND owner.

His insurance will be required to defend him (or change their minds, and pay you)

Did you get the names and addresses of any witnesses?
