Good question! The Nuremberg trails of the Nazi's set the rules around War and Soldiers behavior during War and we are abligated to follow those rules if we what to deserve our reputation as a just Nation and fair Nation in the World. We have not lived up to the standard that we ourselves set after World War Two was concluded and we were victorious.
It is no small matter. America's soul as a Nation is at stake. If we do not start telling the truth about our behavior in the World and start living up to the very standards we set for others and ourself, then we will not be the Nation that our Fathers and Mothers helped to create, and that will be a loss for America and for the World.
The questions are simple. What are we going to decide? What are we going to do? What is America as a Nation going to be in the future?

There are a large host of federal and international laws including treaties signed by the US.
The US does have two limitations for engagement in the Constitution. The US Congress is the sole branch that can declare war and they have what is called "the power of the purse" to halt funding for war.

The Geneva convention states that "enemy combatants" must wear a uniform or badges that designate themselves as a unit representing a state. Why? To discourage Terrorism.
