My son is almost 7 years old. He has no idea who his father is- he left when he was one. There is a ton of back child support he owes- and because of it- he will not get a legitimate job. He has agreed in the past to sign over his rights- but the last time we spoke- he sounded unsure. I would hate to spend the money and risk his putting the paperwork to the side. Anyone know what the chances are that I can have his rights terminated in court anyway?

Don't wait for your ex to do anything... he won't do anything unless forced.
He has gotten by with making everyone else take responsibility throughout his whole life.
You can go to the court handling your child support, and tell them all that you have said here.
You may not be able to completely terminate his rights, but you can specify that he can only get "supervised visitation".

I wish you all the luck. My ex was arrested and did time in jail for attacking our then 3 year old son. The court refused to terminate his rights and ordered him to go to parenting classes, what a joke. Anyways he has never, ever paid any ordered child support and I even wasted my money on an attorney to get his rights terminated and still they said I can't do this. BTW he hasn't seen our son since the abuse over 5 years ago because I refuse. He hasn't taken me to court yet about that but if he did, my guess would be they would make me give him his visitation.

You can't terminate his parental rights...only he can do that.

HE has to file with the court and a judge has to make the decision based on HIS filing.

He is still the father and has the right to his child.

in most states, you cant have his rights terminated unless you have another father to adopt your son who becomes responsible for him financially.
