I recently (2 months ago)... started working at this small boutique. I was friendly to everyone but i could sense something was really strange with the way they were towards me. I never had to sign any papers at the begining and was told how it was important to be at work when I am supposed to work. I was a good worker and did everything I was supposed to do. I was also kind of lost because nobody really tried to help me out that much. Then I started getting calls like I couldn't come in bc it was to slow. Yet other girls were on the schedule and worked alot. The owner wouldn't even call me herself and tell me I couldn't work. I finally worked one day and was again trying to get along with the people I was working with but they were being really short. I got a call after work that I was fired for it being so slow. I called the owner bc it was some girl who had to tell me not even the owner. She told me that there were complaints and that it wasn't her decision to fire me. could i sue?

Im from california. I also know that I was not always given a 30 minute lunch break everytime I worked more then 5 hours. Also I never signed anything. No taxes were taken from my wages ever. Also They talked very mean about everyone that walked in the store. Also i witnessed a little girl working there that was 12 years old. which I believe it against labor laws? Also the store is not too slow i know its not i've seen it get busy. She drives a g-wagon. I've worked with tons of girls before and never in my life had been treated so mean by a work. I guess maybe because it is so small?

Also there were people that worked there with their cell phones out and making personal calls. There were girls there that opened the store late. I feel like I was the new one and actually was a better worker then them. They would leave the store sometimes when they were supposed to be working to go get food or drinks. Also Sometimes they made me do their work for them that I didn't even get paid for (they were paid more then me to do the job).

you have not stated what state you are in and that may make a difference but they can give you all the information you need.

lost wages, get your job back, emotional distress, punitive damages?

it is not illegal for 12 year olds to work if they are working for their parent, which you did not state. poor job performance by other employees has nothing to do with your claim that is ownership/managements problems to deal with as they see fit. i do not know California law in detail but a lot of states only require breaks for minors. those that require breaks only require 30 minutes if break is unpaid so see your labor board for the answers.

I don't know what state you are in but North Carolina is a free hire free fire state. That means you don't have to be in a union to get a job and either you or your employeer can terminate the employment at any time for any reason. The only way you can sue is if you can prove you were fired because of a legally protected characteristic such as age, gender, race, religion, sexual orientation, or national heretage. That is hard to prove even when you know that is why you were fired. If you were told you were fired for being slow you would have to prove that was not the reason but rather one of those protected characteristics. I don't think it is a fight you will win. I'd just start looking for a new job and pretend you didn't have that one because it doesn't sound like you were there long or that they would give you a good reference.
