First to answer your question.......Most states 1 year is all it takes. If she can prove that you two have lived separate and apart for a year a judge will grant her a divorce. My question for you is......Why would you want to remain married to someone who doesn't want you? If its for spite, believe me it will get you no where. If its because you still love her ......then sometimes letting go is the best way to show it. Good Luck...let me know how it goes.

There are a lot of warning signs here. First, the fact that he is 25k in debt to begin with. People go into debt all the time but not for as much as that at his age. Then there is the fact that he lies about the divorce for another. I suspect that he is living with you and if you kick him out, as you should, he will just move on to someone else and live off her for a while. You need to look over this site for how relationships are supposed to be and raise your self esteem if need be but get rid of this guy and find a real man and not a boy who hasn't grown up yet.

Sorry to hear about your marriage but heres the reality. At any time now if you refuse to sign the papers, she can file for divorce based on one signature, and she will get whatever she wants or is demanding and you will lose any right you have in this divorce so your best bet, as bad as it may seem, would be to negoiate with her on this. Its probably inevitable at this time anyway but dont give up your rghts here or you may regret this for some time to come. You can contest her but that usually turns ugly and costly and time consuming and you will still lose in the end so be as friendly as possible and hopefully get out of this with at least your shirt on. Good luck

if you contest the divorce, a lengthy legal battle will ensue. you could conceptually drag it out into perpetuity battling over small issues. however, realize that doing this won't make her love you or want you back. instead, it will cost you a lot of money and probably make her hate you. if you want to salvage your marriage, ask if she will consider counseling. if she won't, then you have to accept that, because you can't control other people. no one has that kind of power.
