It depends. If you live in California employers are required to give a copy of the background check conducted to the employee. In all other states this is not the case. So generally, unless you are in California no background checks are 100% confidential. You only need signed consent to run credit checks not background checks.

All the background checks that have been done on me were for a job and I had to sign a form authorizing it or go to the court house and pay for one myself.

if you are doing it privately, then there is no reason for the person to know it. If it is done for professional reasons say for employment checks, usually the potential employee is informed about it.

It depends upon what methods or agencies that you use. Some places require a signed document allowing certain places to be contacted.
