FMLA is unpaid leave while Workmans Comp is paid by the State. An employer trying to do this could be charged with fraud by the State. What they are doing is trying to make it look like there is no claim on Workmans Comp. When you are on a lost time injury, you get paid by the State. If you make a claim for the money you are owed for this injury, the employer would have a hard time saying you were off on FMLA since you are requesting payment for the time.

I'm pretty sure that it's a federal thing not a state thing, and in Ohio they make us take our FMLA along with our workers comp. I thought that it was a crappy thing too, but there wasn't anything that I could do about it.
