My fiance and I have been together for 8 months now. I am 23 and he is 28. He is Dominican and used to live in New York. He is licensed from the police academy to carry a gun. I asked him if he's ever used it. Last night he told me that when he lived in NY 5 years ago he was on the subway and was wearing an expensive jacket with expensive shoes. A man came and told him "Your shoes and jacket look nice, what do you think to take them off for me.." and my boyfriend got close to him and told out his gun and said "What do you think about my taking this out?". Then the guy went away.

Is this illegal or is this called defending yourself? I want to know if this is something he can get in trouble for. He is such a kind and good mind and doesn't start trouble but is ready to protect himself and his family if need be.

He was defending himself. He felt threatened so he responded by showing that he could defend himself. He was licensed to carry so it was not illegal that he had a gun. If more people were able to do this perhaps the muggers would think twice about who they pick on. Someone tried to car jack my father and he reached over and pulled his gun out. His was bigger and the car jacker took off. I guess he didnt want to mess with a crazy 80 year old WW2 vet who still carries his army issue 45. Not that I think it was the wisest thing my Dad ever did but he's not about to give up what he worked hard for without a struggle.

Personally I would consider that self defense, the guy was trying to rob him and he didnt wave the gun around and flash it ro anything, he just mentioned it to get the guy to go away - but thats just my personal opinion

since the man was not trying to kill you b/f, and he responded with a deadly weapon, legally it is a death-threat, but since it happened in N/Y. Who cares. Hundreds die there every day.
