Background, I need to declare bankruptcy. I am unemployed. I live with my parents in their home. I have few assets Car,Tv and Hifi. My debts are unsecured, Loan and credit cards.

I have located a Statement of affairs (debtor's Petition) Form 6.28.

The form asks do i have use of another motor vehicle.

I am a named driver on my dads Insurance does this count ?
Why are the asking as i don't own the car ?

It then goes on to ask how much do other members of your household contribute each month to the household expenses.

I don't know what my parents income is (one retired one working part time) It's not the kind of question they would answer even if i asked.

It then ask for the total Household income
The Name and ages of all occupants of your household and if they are dependant on you.

Are they trying to involve my parents in my debt ?

Thanks 4 reading all this. I would apprecitae answers from people who have filled in this form/ those who help people fill it in.

Thanks everonline,

I have asked parents for fianancial details but they won't give any. Do you know what effect that would have on submitting the form ?

Can the force my parents to answer ?

I hope not as my relationship with them is shakey enough anyway.

It's nothing to do with your parents, they are asking whether you have any outgoings related to dependents.

They are asking about a second car because if a car is deemed necessary for your employment then they can't take it/make you sell it as part of your repayment scheme. If, on the other hand you have the use of a second car they might consider you selling the car.

Don't worry your parents won't be landed with any debt unless they have signed a guarantee.

Edit : If you dont have the information on your parents as requested. just put "not known" (speak to somebody at the insolvency service first, if you like).

As somebody else has stated, are you sure you don't want an IVA?

Asking for this info does not mean they would have an interest in the car just in the fact that you have the use of it which could involve reduced travel costs or in fact more. Also your parents income and bills have nothing to do with it when you do your incomings and outgoings just put the rent you pay to them and if it includes toward council tax and gas, elec, water. It would be wise to get at least a letter from your parents confirming the amount you pay for rent to them. As said these forms are designed for those with household committments. Just put it as it is and get confirmation either with bank statements to show the payment or with a signed letter from your parents.

Hope that helps.

I'm surprised you are going bankrupt .. I would have thought an IVA would be a better option ...

The questions all assume you are 'head of the household' .. you should answer by considering yourself a Tenant [and your Parents as your Landlords] even though you don't pay rent ..
