i work as a security guard overnight, the mall manager refuses to turn on the parking lot lights even though ive asked for months, anyway, i was doing my patrol and i mis stepped the sidewalk because i couldent see the edge due to it being pitch dark, and i fractured my ankle, can i sue the mall or the manager?

and btw, i do not work for the mall, i work for a security company hired by the mall, and in response to the flashlight, we are not issued flashlights and we are also not allowed to have anything on us except issued uniforms and duty belt, i cant even carry my wallet around i have to put it in a locker

Nope you donot have a case, because being a SECURITY GUARD you should arm yourself with a FLASHLIGHT, isn't this part of a guard tools whether night time or morning time.

That is the mall mgr. prerogatives if not turning on the lights on the parking lot, you should have use the flashlight in inspecting cars park there. You GOT NO CASE. You are just using the darkness in there for an excuse to charge the MGR.

The case should be against the security company because an employer should provide sufficient equipment to employee in ensuring their safety. Now your employer forbidded issuing flashlight to you and you are forbidded to bring your own. The responsibility should be in your employer.

Anyway, check with your union lawyer.

Assuming you work for the mall company, the answer is no in most American jurisicitions due to the workers' compensation bar, that makes workers' comp, not civil lawsuits, the exclusive means for employees to get compensation for on the job accidents.
