BTW...this isn't for me. If 2 parents are divorced and the mother has sole custody, but the dad has always paid child support, can the mom legally change the last names of the children without the father's consent?
I'm not sure if this makes a difference but the mother and children live in Pa.

It's actually a long and sad story. ut she has full legal custody.
The saddest part is it happens all over the world waaay too often. Sick and evil. and only the children suffer

Actually she told them when they were little that he did terrible things to them (It didn't happen). She also did the same thing to her eldest son's dad. The kids want nothing to do with the dad. This has been in the Courts for 15 years and she still hasn't even had to go on the stand.

Does she have full parental custody or just full physical custody. There is a big difference in the two. If it is just full physical custody- meaning that the children reside in her home and only visit with the Father. Then no she can not change the childrens last name. If she has full parental custody - meaning that the Father has no rights to the children then yes she can in fact change their names.
Unfortunately, Child Support, Child Visitation and Child custody laws are all outdated. More harm comes from the courts that are supposed to be looking out for the best interest of the children then good does.

Maybe, she'll have a bad accident - sounds like she deserves it.

I am a woman (Hillary) but I detest women who pull this sort of thing. She is obviously full of nothing but, self-concern. She doesn't even know how to begin to love and nurture her own children. ugh

Have the father contact the courts in the proper jurisdiction and let them know this is not acceptable. Sadly, the mother does not have to go through legal avenues to change the last name at school, on their SS card or, IDs and I'm not sure anything could legally be done to prevent it.

I think it would depend on who has LEGAL custody of the children. There are two catagories of custody: legal and physical. Most divorces will state that the parents have joint legal custody therefor you would have to get permission from the father.

If she has full custody, she might beable to do it w/out the fathers concent. The father definantly needs to talk to a lawyer, as long as he's paying child support & is involved in the child's life (visitation, etc), than he should have a say in it.

I know in Calif the mother cannot do that without the father's consent. Why would she want to anyway? That is a terrible thing to do, the biggest insult possible to give to the father.

A lawyer will walk you threw the steps for that as long as the minor child has parental consent.
