I was driving home from college (NY to IL) when I was pulled over by a State Trooper and he gave me a ticket for 91mph. I have no clue what to do as this is my first ticket. There is a plead guilty and not guilty. I'm don't think I can make the court appearance as I am a full time college student. What should I do? My friend said talk to the local District Attorney but I don't know how to find him/her. Appearance location is Avoca, NY in Steuben County which is like an hour and a half away from my college.

Read the instructions on the ticket.

If you a re required to appear in court - then you _must_ appear in court.

You may be able to contact the court and ask for your hearing to be rescheduled - but you will have to make it to the hearing.

Whatever you do - make it to your court date on time! If you do not there will be a warrant for your arrest and your license will automatically be suspended.

On the bottom of the ticket there should be a set of boxes that will tell you the name of the court , its address and phone number. If you want to try to do it on your own, you can always call and ask for the contact info for the DA that handles their traffic violations. However, be prepared for little simpathy from them, it is extremely rare for a non attorney to contact a DA about their own open case and remember it is the DAs job to argue for the other side.

You also want to look about 1/3 of the way down and there will be a little box that has a dot next to violation or misdomeanor(misd)

If it is just a violation, the worst you can get is a fine and maybe points on your license. If you get points, that will effect your insurance.

If its a misdomeanor, there could be some jail time floating around, but with just a parking or speeding ticket we dont see that a lot.

If you plead guilty then you can do it by the mail and they will just give you whatever the DA feels is appropriate but as I said before, dont expect them to be lenient.

If you plead not guilty you will either have to appear in court or hire a lawyer to appear for you. If you want to hire a lawyer call the NY Bar association, explain it to them and they will give you a referral for a lawyer that meets your terms. Our firm regularly gets referrals from the bar association.

Plus it cant hurt to make calls and ask, our firm usually charges only 100-150 to deal with traffic tickets and a large portion of the time we can get them down to no points and can get them down to a minimum fine... so like the cost of a parking ticket.

The reason he MUST appear in court is that anything over 20 mph over the posted limit is criminal traffic offense. He could lose his license for a year, or get a rather huge fine. With it being his first ticket, they aren't really going to look at that. He was going 87 in a posted 55 mph zone. Not only is that a blaintent disregard for the laws of the state, but unsafe to himself and other drivers on the road. There is a reason for speed limits. From what I have seen/heard, he will more than likely have his license suspended. During that time, he would have to prove that he has insurance to be able to get a work restriction license (allowing him to drive to and from work only - anything beyond that equals driving on a suspended license and could result in time in jail and /or longer suspension). You were very lucky that you weren't arrested right on the spot.

I thought that speeding by 25 mph gave the police the right to arrest you.

I suggest that you contact a lawyer before you do anything as I also think that pleading guilty and paying the fine may result in your license being suspended....

If you plead guilty and pay the ticket make sure you use a credit card or at least make sure you do not lose the reciept. I have had to double pay on two different occasions.

There should be a number to call on the ticket. I suggest calling that number and paying the fine.

Either plead guilty or hire a lawyer and pay $400 to the lawyer to get it waived and save your insurance....or bite the bullet and send the money.

With some FEDERAL RESERVE NOTES. (Or a credit card). Read the FEDERAL RESERVE ACT OF 1913. It explains pretty well how the US (LEGAL ONLY)( not the"lawful" one) monetary system works today
