On June 1st 2007 my son was at school and playing around he got a small stick and was going to place it on somebodies neck to make them freak out thinking something was on their neck. What happened was he accidentaly poked one kid in his ear.
School never contacted me.
I did not hear about this until late July, because my son told me that the kid said he was ok.
In july I get a call from the kid's mother, saying that it got worse, I agreed to pay all MEDICAL bills.
In September I get the bills for gas,medical bills (w/o reciept), and some tennis club membership. I disagreed to pay until she signs a liability waiver. She diened and dragged the school etc... The archiocese paid her $1000.
From later September to now there was no contact.
Today I got a letter from a law firm pretty much saying I am being sued.
What can I expect in court?
How much can she get from me?
Do I have any chance? I don't think so

I am just worried becuase apparently that boy is not getting any better.
I just don't want her to sue me for thousands upon thousands of dollars claiming them as future expenses.

I even said I would pay for all medical fees, and compromised on the gas even though it was 1 dollar per mile driven.
I just don't know why I need to pay the tennis court membership.
She refuses to talk to me or my lawyer throughout this whole process.

she will have a hard time proving neglience but work for a settlement for the drs fees/lab work etc and gas. She needs to provide you with all the medical bills and the total distance she drove. I do not see where paying for her tennis membership would come into play. That is something that is not related to medical, and you shouldn't have to pay for that.

I would see her in court - how can she realistically expect you to pay gas bills and tennis club fee's ?? What have they got to do with her sons alleged injury ???. Hold out and let a judge decide - I would. Good luck and hope you win xxxxxxx

Ask for medical proof that the alleged injury is due to to your son with the stick before doing anything else xx

Seek for an amicable settlement of the case by paying every expenses that were incurred due to the injury caused by your son because if the case is filed, litigation expenses will be pegged on top of the other fees.

To sucessfully sue someone, you need to prove two things... damages and negligence.

She is going to have a difficult time proving negligence. Carelessness, yes... but I don't believe there is any negligence.

I think she is taking advantage of your offer, hoping to entice you into paying more money, and this will never see a courtroom.

I would run it by an attorney to be sure.
