My son was a victim of armed robbery a couple of nights ago. The 17 year old took fifty dollars from my son and held him at gun point. The kid picked the wrong person because my son is very observant and was able to pick him out of the school's yearbooks the next morning. He was caught and arrested. If we choose to prosecute (which the state will do anyhow) my son will have to face this criminal. I'm concerned that if his friends are present then they may come after my son and do God knows what! What is your advice?

I think that this is a very distressing and important question. The answer to this should be a no brainer "of course he should testify" but you raise some very important issues here.

That society has deteriorated to such a level that we are intimidated by the wrong doers is dreadful.

Still I think that yes your son should testify but I think that you should discuss your concerns with the prosecutor and the police and get what reassurances that you can in writing.

Regardless though we must always testifying - not doing so encourages these evil people!

This will be a good civics lesson for your son. Teach him to do the right thing and testify. If someone threatens him, it is a criminal act. He should report anything that even hints at witness tampering to the District Attorney.

Recently, in Pittsburgh, PA a man was on trial for killing a state trooper. During the trial, for various reasons, a total of seven people in the gallery were arrested and jailed. Witness tampering and jury tampering were some of the charges.

Don't worry about it, I am sure the other boy is not involved with any organized crime syndicate(at least I hope not).
It isn't as if he witnessed a mob hit or anything and the other boy is a worthless thug who needs a good old fashioned A-ss beating!
Your son owes it to his future to get rid of unredeemable thugs like this one or he may run into the same boy in the future and if not punished now, the boy may be a very dangerous man.
Stop the punks before it is too late, that is what is wrong with most countries, most people are too lazy or scared to do their patriotic duty!

If you let this guy skate, he will likely rob someone again, and possibly kill someone the next time, when he can be stopped temporarily here, or you can opt to play it safe , refuse to testify and let him walk. You have to weigh the risks. Yes, there is a great possibility retaliation will be forthcoming, especially with young thugs who think they are invincible.

That's hard to say, but most cases are plea bargained, see if the prosecutor can get plea bargain with your son's testimony, so that if will not go to trial

talk to the prosecutor about it. but be careful. prosecutors use witnesses like pimps use whores. so get promises in writing. but truth be told, there is no guarantee that their won't be retaliation.
