Biblically speaking it is adultery and that is the view of the church as a whole. The only factor based on your question is that common law does not apply to a person who is already in the enactment or institution of marriage and greatly depends on the jurisdiction of where the act happens.

First, 'common law' marriage, even where is is legally recognized, is NOT possible is either party is legally married to someone else.
Second, 'church consequences' is a bad term. The church is usually not responsible for punishing behavior. Every religion I am aware of would consider the behavior you appear to be referring to as a sin.

This might be one of those "It's God's Will" things. If he didn't like it, would he 'let' you do it? Cuz we know god doesn't like that stuff. But maybe if it's god's Will......most things are, ya no.
