you really need official help on this one. if she's only been gone 24 hours, is there any chance she'd want to come back to the marriage? if it's really over you need to apply for custody of your daughter; you'll need a residency order that also allows your mother to look after your daughter while you work. you can get a temporary order while everything else is sorted out. good luck. diane.

You cannot take a minor out of the country with out a notarized letter from the other parent..married or not..the other parent can claim kidnapping, keeping the child from seeing her and a hundred other things..you could be looking at serious jail time..wait until you get full custody of the child..then you can go where ever you want ....think of the child, he/she loses a mother then dad leaves her/him with people they don't even know and disappears too..please don't do that to that baby..find a good day care..good luck

It shouldn't be kidnapping if there's no court ordered custody. Leaving the child with your mother will be fine, especially light of your ex's disappearance. Make sure your attourney knows this when you do go for a custody hearing.

Why would it be kidnapping? She is gone, nowhere to be found and you have to put food on the table. I would speak to an attorney about this first though.

well it sounds like you are being a responsible person your mum will take good care of your child.If your wife thought anything of her child she would have taken her with her,did she know you were about to go abroad?

You should consult your attorney, but it seems okay to me.
EDIT: Oh wait, are you saying that you are going to take the child to your mum, who lives out of the country? This is another situation altogether. Please consult your attorney about it.
