I bought a phone on Ebay, and received a child's book in the mail. I've emailed Ebay and filled out a claim with Paypal. Ebay sent me an email 3 days after I paid for the item saying the user was fraudulent and his account has been suspended. It says that the item was not covered with Paypal's buyer protection insurance. Does it look like I will get a refund? Is anyone familiar with Ebay's policy?

the seller has been suspended from his account...and I don't remember his user ID...and Ebay deleted the item I won...so im outta luck there :(

If the item is not covered under paypal's buyer protection insurance, then I am afraid you won't get your money back. :(

I hope it wasn't a lot of money.

To be honest, I don't think you will get a refund. I was scammed on ebay and the guy was pretty smart. I sold my psp for $200. A couple days later he complained to us about the buttons not working AFTER he told paypal WE scammed him. I lost my psp and the money. He ended up keeping my psp. It was if I gave him the psp. Paypal will not be any help to you. They weren't any help to me and my mom basically cussed them out. I'm sorry about what happened but paypal will likely just forget about you with basically a f**k you we dont care kind of way. I hope all scammers BURN IN HELL.

The buyer protection is for items that do not work properly when you receive it. Fraudulant sales like yours are covered. Paypal will investigate and if they find in your favor they will refund your money if he has it in his paypal account. Fraud is fraud and paypal does protect you for that.

If your paypal account was paid by a credit card...Some credit cards offer buyer protection insurance. Maybe your loss due to fraud would be covered by your credit card insurance.

Please tell us who the seller was so that we can all avoid him/her...I am sorry to hear of your loss....I think that person sent the childrens book to get a tracking number to cover himself/herself...Obviously it didnt work as planned...
