Yahoo is no place to be asking such serious questions. Even if you have what you feel is a good reason such as a good job, a sick family member, or if Dad is abusing the kids, you need to make sure that the law is on your side. Be very, very careful with this.

If your husband agrees to it and doesnt make a fuss then yes you can.

But if he says NO, because it will make visitation difficult, then you have to get permission from a Judge, however that may not be possible as the childrens Father has rights too, so it can be stopped.

YOUR rights???? What about your child's rights to have equal access to his/her parents?
You child didn't ask to be born or to cause what ever problems arose in the marriage and somehow you think you are the one with rights here? Over and over again we see kids who are denied seeing a parent because the parents can't be mature and work things out.
Work out a plan with your ex which focuses on the kid and not carry over your anger and upset with the ex.

Read your divorce papers and any agreements attached to it with regard to the terms of guardianship agreements it will all be in there.

It depends on what was agreed to in your settlement what your rights are. If you want to have them amended you need to seek further legal advise and possible go back to court.

The other option would be if you get your ex's agreement in writing and notarized to allow you to leave the state with your children.

in arkansas you have to have the judges permission to take the child out of state. The dad has rights to see his child too.

you really need to check with your state laws, most of the time possesion is 99.9% of the law, he'd have to fight you to get them back, but no way am i going to go into this further..please check your state laws, and there are attorneys who do not charge a consultation fee~

Check your state laws... you may be of guilty of "interference with custody" which is a felony in Alabama....
