Hire an attorney. Ask him/her. Do not seek legal advise on Y! answers.

Good luck.

Is she a Canadian or American citizen? Well the best thing is to do is get a lawyer to get the paper work started. After 3 yrs if she haven't got back with him to solve their differents, that when the two of them should file for a divorce. So, get a lawyer and he will tell you what you need to do. Do he have any ideal where in Canada she lived? Ask his parents -in-law...

Yes, in my country usually after 5 years of separated the court can grant the divorce certificate...but the court need to advertise in a newspaper or something like that that he/she want to divorce him/her and ask him/her to come to the court to settle the divorce issue. Between a period of time he/she don't show up than the court will automaticly give the divorce certificate to him/her.
But it might be different in your country...you can ask the marriage & divorce registration department in you country for an advice.
