I doubt it. If that were true, you could be sued for writing something bad about people in your diary.

Such things are highly governed. You can't just write how a person is a ***** or you don't like them. But some things may be interpreted as negative. Say you are still sick after a long time, the nurse would have to observe that you are not thriving or not improving. If you have a poor attitude, that would also be noted. Behaviors have to be noted along with symptoms. But they can't make value statements about you personally. If your chart says 'patient is stupid.' I would sue. But the odds of this happening, with the number of people who see your chart, it's not a high chance. So they do have to chart you, but they have to be nice about it, and can't make personal value judgements.

Depends.

Was what was written false? Did he/she write in subjective terms? Was it an objective observation? Was it malicious? And a key factor would be what was written untrue?

The final measure is did this harm you in anyway? I am not talking "it upset you", I am talking about seriously hurt you. If not then - no.

A nurse cannot write "the patient is an obnoxious jerk", but she can write the "the patient is uncooperative and verbally aggresive with staff". She can't write - "patient smells like a weeks worth of bad trash", but she can write "body odor present, patient appears unkept".

It all depends on what was written, why it was written, and if it harmed you. If it was a true observation but worded badly the best you can do is complain to her superior.

Call the hospital and get the charge nurse on his or her floor and file a complaint. Make sure to get the records first. No attorney would take that case unless it was really bad and the hospital knew about it, did nothing, etc. However, the damages are so small it would not be worth your time.

Depends on what it is. If it's something that could affect your health care in a seriously negative way, then yes. If it's just a rude opinion, then no. You could possibly report her for misconduct, but I wouldn't sue a nosy nurse if I were you, wasts time and we're short on nurses already.

Define the term 'BAD'...

Notes often reflect more than med changes...they also note behavioral modifications which may indicate further medical attention.

Please explain what the bad is?

If it has nothing to do with her medical care then possibly -but its depends on what the BAD is.

I don't think you could sue....but again what is the bad....but you can definitely get her in HOT water with the facility she works at..

You would have to show actual damages of some sort. Did it adversely affect your care? Keep you out of work longer? Did it cost you something other than hurt feelings?

no she cant get in trouble but you can go to the admister and get it blacked out. dont let them tell you other wise. I have done it so i know it can be done. good luck
