You can sue anyone for anything. You just won't get money unless you can show a loss.

Normally in this type of situation, you will end up with attorney fees and court cost, but no award from a jury or court because you can't show a monetary loss.

The best thing to do in this case is to contact the police department and report it. Any cop using racist remarks in this day is a liability for the department and will not have credibility in court when testifying.

If you have a witness write a letter to the chief of Police. Write one anyway because the cop has probably had comp[laints before and they will believe you.

Only teh PC police. Words are words, there is no law pertaining to diction with the exception of words that could potentially cause harm, Like yelling Fire in a crowded theatre.

Actually if it offended you then yes because there is a limit on freedom of speech. And racism is against the law and police officers are not above the law!

Good luck proving it in court.
If the only evidence you have is your word, and the only evidence the cop has is his word, guess who the judge is going to believe.

But if you have it on tape, you might want to send it to the local news instead.

No, you can probably file a complaint with the department. They have to babysit the scum bag, pieces of $#!+ all day and night, so I can imagine they get frustrated and let some words fly, that they probably shouldn't.

If you weren't committing a crime, he might not have called you (or your friend) what he/she did.

No. Suing wouldn't be correct, because whats the basis of the suit? Reprting it to the Department he or she works is the better option. He has committed no crime, however ignorant it may have been.
