ive been married almost 18 months,seperated 6 months of that,i want to divorce her but she doesnt want it,she filed a divorce against me(thinking i would not sign),i agreed to the petition and the particulars(even though it was horrible malicious nonesence)but i signed anyway as i wanted the divorce,trouble is she retracted the petition and wont carry on with it,out of spite i guess,just game playing if you ask me,i want closure on this disasterous marriage but i just cant afford to put a petition in myself,and even if i did raise the funds for it she still would not sign the papers anyway so i would have waisted my money,so the question is,,,,,,,,,,,how long do i wait before we become automatically divorced and/or what other ways are there for me to get the divorce?.....some people say its 2 years some say 5 years but then what would i need to do then,,,,,so confused and desperate to get this woman out of my life for good.please help.

I know you have to file papers, if she does not sign them in X amount of time you will become divorced. This is what happened with my parents. It may have been 2yrs??? When you file the paperwork, they will tell you the length of time.
You need to get a lawyer.

There is no such thing as an automatic divorce. At least not in the states. The courts much grant the divorce. Get a lawyer, since you already know she is going to contest a divorce, so offer her nothing and work from there. Just because someone won't sign a petition doesn't mean that a judge isn't going to grant the divorce. It just means that he/she will decide who gets what and it may or may not work to your or her advantages. And it does cost more right from the start. Call a lawyer.

I fear the only way to get divorced is to get a lawyer. You will have proof that you have been separated and you need to show him the first petition for divorce. More than likely if you file then your lawyer is going to have a hayday with your wife! He will be able to show that you weren't asking for anything but the divorce and she denied you that! You really need to get a lawyer, a divorce just doesn't happen, ever!

I feel a sense of you bull shtting too. Most states are no-fault divorce states. You can get the funds. Quit being a lame whimp and file.
