Who are the players in a HUF?
A HUF consists of: Karta
The karta has to be the oldest male in the family. If he passes away, his wife cannot become the karta. His eldest son will take his place. If he chooses not to, he can give up his right and the next son in line can take his place. But If Eldest Son Neither wants to give up right Nor he wants to sign any paper, in that situation what to do ?

The best course in such a situation is to go in for Joint Hindu Ancestral Family Property partition, where each member of the such Hindu Family who enjoys the legal right on the joint property of such Hindu family gets his or her share as the coparcener. Then the question of any domination or non action by the present Karta won't arise as each of the coparcener enjoy their share in the said property individually as their self acquired property. No use prolonging such issue where decade’s long litigations once started on the basis of dispute of HUF & Karta continues & finally one day the progeny of the present generation come to this very decision to call it a day & go in for partition of such joint Hindu family property which I have suggested now in 2007.
