The "law" that I've been paying taxes for over 50 years turned against us recently as a detective came to my friends home with extremely lewd and obnoxiously explicit allegations from this female friends stepson. Why can't the detective see through the lies he told? Don't they do a thing to protect innocent people anymore?
Now, the friend has to hire an expensive criminal attorney, as the person causing all the trouble allegedly was interviewed by this detective. The lies were so "Jerry Springer" that they made the father of this child practically laugh in the detectives face.
Meanwhile, I'm being harrassed by local law enforcement with 180 turnabouts and close surveillience as I drive through the town doing volunteer work.
I feel like something real wrong has happened to America when liars are allowed to abuse the system and waste taxpayers money in such incompetence.
Are we doing enough? Can we file harassment charges? Isn't it criminal to file false police reports?

Lisa I believe you to a degree, but I can assure you with my life that this "child" is a pathological liar who gets his direction from a psychopathic individual with a severe personality disorder. They make a living fooling law enforcement.
I'm old enough to be the detectives father and believe me, he makes Clouseau look intelligent. There is no money for law enforcement, and it is painfully obvious all the way up through their court system.
This character uses a voice activated lie detection device that he manipulates, claiming that if you don't have anything to hide, you'll be fine. My friend wouldn't allow it but would allow an independent one done. This all costs thousands! No taxpayer is going to help except one with enough money.
If I fight back, all I'll get is jail which will kill me or worse bring on another stroke.
I've fought cancer and had heart surgery: The person who is doing this to my friend knows this, yet whines about not getting his way.

Thanks Richard. You know what your talking about. It's exactly what happened here but I seriously doubt that this detective ever did a one on one as the accuser(s) live hundreds of miles away.
Stll in the same State.Do detectives just lie like that? Why? I thoght they were supposed to investigate not incriminate?

Unfortunately, there is not much that you can do in this situation. I don't fully understand your role in the case, however. It seems that you are a possible witness, is that correct? If so, you definitely have rights. Of course, your friend needs to get an attorney before any more questioning by the police. He or she is entitled to that.

First, lets talk about the abuse case. It is unfortunate that innocent individuals can sometimes be caught up in the system. It is especially unfortunate when you think that those resources could be going to solve legitmate cases. Having said that, of course they have to investigate claims of abuse. Can you imagine if they did not and they turned out to be true? If the allegations are false, they generally prove to be so in time. Made up allegations do not generally stand the scruitiny of sound questioning. For example, there was a recent teacher abuse scandal where the student alleged the incident took place at a certain time and, fortunately for her, she had a dr. appointment at exactly that time. Specific questioning will lead to the truth provided you are dealing with professional law enforcement. If that does not happen, it may have to get to court before the whole truth comes out.

As for your treatment by the police, I do not understand why they would be harassing you. If you are a witness, either character or fact witness, you cannot be intimidated by either side. If you feel that intimidation is occurring you certainly should visit your local prosecuting attorney and make a complaint. Also complain to the police department. If none of that works, contact your state police and then your local FBI office.

As for filing harassment charges or any other criminal action, such a filing is solely within the discretion of the prosecuting attorney. It is unlikely that such a charge would even be considered until the facts in this situation are fully known. Even then charges will generally be filed only if the victim intentionally misused the system. If you believe that to be the case, try to determine the victim's motive in doing so. That will go a long way in disputing the allegations as well.

Get a good criminal defense lawyer, and do what he tells you. Juries have a tendancy to believe even the most bizarre claims by minors alleging abuse.

What you describe is the "ideal world", but it's by NO means universal across the country. In many places, especially in smaller police departments, there are no specially trained investigators, on-call therapists, or anything else, and interviews of children alleging abuse are indeed carried out by whichever detective gets the case.

Get a good lawyer. If the police want a conviction they will go to any length, even fabricating evidence, I'm in Australia, was falsely accused of malicious damage...he was pushing me(a pedestrian)out of the way with his car so I began slapping his car with an open hand. A month later he went to the police and said I had damaged his car...there were 2 dents like made with a hammer!
I had a written opinion from an assessor that I could not have done the damage with my hand. His statement was dismissed by the judge because it was not in person. I did not hire a lawyer, and paid for it by being convicted. The judge was more interested in proper procedure than justice. If I'd hired a lawyer I might have beat the charge.

Are you in America? Because in America kids are not interviewed by the detective,they are interviewed by a team of therapists who specialize in abuse. They know what they are doing and they do not prosecute till the abuse is founded. They interview the mom and the child, sometimes others who are involved in the child's care. No child can be brain washed enough to jerk these professionals around. Usually detectives serve as the interviewer for the suspect and the suspects friends and family. They too are specialized. I know it is hard but you need to stop defending him because if they say he did this then he did it.

Sounds like it's time to "fight fire with fire"- my friend. Go get a GOOD Lawyer; tell him what you've told US; and then after you've won your "Day in Court", file Civil Damages against the Detective AND the Office He works out of. If the Law insists on "playing" with your Life, then YOU can insist that they PAY for the privledge... Good Luck!

Good luck. Be honest and stick with the facts. Get a lawyer. Eventually the police will question the inconsistencies in the made up story.

Hire a good lawyer. And in the meantime, try to find a place to crash while the protective action is in place - maybe a friend's house where there are no kids.
